Robyn, DOR (as does all of state government) has a new web site and with that comes issues of migrating content. I will let our webmaster know the link is not working.

The link for the city local food and beverage updates is no longer working (its the first "here" posted under "Local option meals tax has generated $11.3 million" at http://revenue.blog.state.ma.us/blog/2010/05/local-option-meals-tax-has-generated-113-million.html. Usually all the new local food and beverage rate enactments are posted there but the link hasnt worked yesterday or today. Thanks!

Shelby, IKEA must abide by the rules of the sales tax holiday on August 13 and 14.

I contacted IKEA US to find out their policy with regards to qualifying online purchases and the tax-free weekend. Here is their response. Can they do this?
"Thank you for your interest in IKEA. We appreciate that you have
taken the time to contact us.
At this time IKEA Home Shopping will not be participating in any
tax-free weekend events. We do apologize for any difficulties.
We do hope that this information has been helpful, and we thank you
for giving us the opportunity to assist you.
Best Regards,
Nezhat

Vanessa ... the Legislature has not yet set a date for a sales tax holiday weekend, but it will likely be in August and the date mentioned so far is the weekend of August 13th. We will post news when the Legislature approves and the Governor signs.

we are leaning towards the end of July. Will there be a tax free weekend this year in August? No dates or information has been released.

Germaine ... the Legislature seems to be leaning toward enactment of a sales tax holiday, but no proposal is before them as yet.

I am wondering the status of a Tax Free Weekend this year, 2011? I know that in 2010 it was approved for the second weekend in August. Any information on this?

Today is the last day to file state taxes. Why is the no extended hours for people who require assistance. 10-4 for customer service after a 3 day weekend for state employees during tax time is absolutely aweful customer service.

I will be moving out of state in December, do I have to notify the MA DOR? Is there a special form or will they know when I file my 2010 MA taxes?
Thank you,
Larry

Patricia, your question about the bounced check is a good one, and not that all uncommon. If you took possession of the item during the sales tax holiday weekend, there is no sales tax to be paid when a new check is written (or other form of payment made) and the vendor is not required to charge you or collect sales tax. The vendor may, however, charge a fee for the bounced check, a matter that is separate and apart from the question of the sales tax.

What if someone's check bounced after they paid for the item on the Mass Sales tax holiday weekend?

Joan, there is no form required for ordering out of state. But you must pay for the item during the sales tax holiday weekend, otherwise use tax would be due.

Is there a form for ordering an item from out of state, say, from Dell?

As an operator of several convenient stores, this tax holiday is a big time pain in the butt, especially with alcohol products included this year. There should be exemptions for purchases under $100. If a retailer advertised a weekend sale as "6.25% off on everything in the store!", I don't think that would get a lot of people very excited. Like "saving" 2 cents a gallon on gas, it's a fickle consumer mentality that is trumped up by the government and the press.

Can you comment on the article printed in the Mass. Lawyers Weekly on 10/26/2009 regarding the Act Improving Tax Fairness and Business Competitiveness that explained that Condo Associations even small ones such as 2 or 3 units are swept up in this legislation and will need to pay taxes as a corporation?
-A concerned condo owner
Lauren,
The Governor last week, as part of his legislative effort to
solve a $600 million revenue shortfall, submitted legislation that would correct this situation and basically bring things back to the way they were. The proposed legislation clarifies that the the 2008 "check-the-box" corporate tax reform law will not increase taxes on condominiums organized as Massachusetts business trusts. It is now up to the Legislature to move this proposal forward for approval.
